Allegations of sex crimes, and investigations of sex offenses, are life shattering for the accused
The Neal Davis Law Firm won a huge victory on Oct. 26, 2021, by getting Texas’ child erotica statute declared unconstitutional by the Court of Appeals.
“A person facing a sex crimes charge is at one of the lowest points of his or her life—especially if a child is involved. The most common child sex crimes include indecency with a child, sexual assault of a child, aggravated sex assault of a child, online solicitation of a child, and child pornography. People automatically tend to presume that a person accused of a sex crime is guilty. Family and friends may have cut them off, and they may be having employment problems since being charged. In short, no matter how strongly they have denied the allegations, others have essentially dismissed them. That is why they need someone to speak up for them, give them hope, and fight every step of the way.”

“This man saved my life from false imprisonment. Neal’s belief in ‘liberty and justice for all’ as laid out in the Constitution of the United States, and especially as that principle relates to constitutional rights regarding the receipt of a fair trial, coupled with his refusal to quit fighting, are attributes of a noble spirit and a man of high character.”

“Neal is the best attorney anyone could ever want. We started out in a situation we thought we would never be in with our child and a parents worst nightmare. Our son made a mistake while suffering from ptsd and at first we had a horrible attorney and things just didn???t feel right with her so we prayed for God to send us the right attorney. Neal was that perfect attorney we needed. His devotion to our son and his case was phenomenal. He was very professional and knew exactly how to handle his case to get the job done. He kept fighting for our son and we will forever be in his debt for that. If you need an attorney that will care about you and fight for you then Neal is who you want and he is worth every single penny! We pray blessings over him and thank God for him every single day.”

Why child sex offenses are different
Being accused of a child sex offense, such as aggravated sexual assault of a child or indecency with a child, requires a lawyer who knows how to handle these unique cases.
For various reasons, child sex crimes are different from other crimes – from how to attack them during the investigation phase to how to cross-examine the child complainant at trial.
Child sex crimes also have specific evidence and procedure rules unique to them. The range of punishment in these cases depends on the charge. Further, upon conviction, sex offender registration is required, sometimes for life.
Child sex offenses include:
Indecency with a child – When a person engages in sexual contact with any person under the age of 17, or exposes himself/herself to a child, or forces a child to expose himself or herself.
Sexual assault of a child – When a person engages in sexual penetration with a child 14 to 16 years old.
Aggravated sexual assault of a child – When a person engages in sexual penetration with a child under 14 years old. Texas also imposes a 25-year minimum sentence on cases of “super” aggravated sexual assault (assault of a child age 6 or younger).
Continuous sexual abuse of a child – When a person age 17 or older commits two or more acts of sexual abuse over a 30-day period or more, against a child who is younger than 14 years old.
Improper student-teacher relationship – When an employee, including a teacher of a public or private elementary, middle or high school, engages in sexual contact with a student who is enrolled at the school or school district where the employee works.
