Johnny Holmes, the legendary District Attorney of Harris County, Texas, used to lecture his prosecutors not to seek a “damn fool result.” Why should a businessman, who has no criminal history and is arrested on intoxication charges when he is 40 years old, have a criminal record for the rest of his life? Prosecutors in these cases would often dismiss the DWI when a person paid a fine and got treatment because to do otherwise would result in a damn fool result.
Prosecutors, in short, did the right thing.
Unfortunately, that’s often not the case anymore. Nothing makes me feel better than fighting to avoid a “damn fool result” and seeing my clients go back to their normal lives. It is good not only for the client but also society.
